resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration
agreement.
Waiver of Jury Trial
BY AGREEING TO THESE TERMS, YOU AND CASE FLOORS WAIVE THE RIGHT TO A TRIAL BY JURY IN ANY LEGAL PROCEEDING.
Waiver of Class Actions
All Disputes must be brought in an individual capacity. You agree that you may not bring claims as a plaintiff or
class member in any purported class action, collective action, consolidated action, or representative proceeding.
The arbitrator may not consolidate multiple claims or preside over any form of representative or class proceeding.
Exceptions
Either party may bring an individual claim in small claims court for disputes within the jurisdictional limits of that
court. Additionally, CASE Discount Flooring may seek injunctive or equitable relief in a court of competent jurisdiction to
protect its intellectual property rights.
Severability
If any portion of this arbitration provision is found to be unenforceable, the remaining provisions shall remain in full force and effect.
11. Governing Law
These Terms and Conditions shall be governed by the laws of the State of South Carolina, without regard to conflict of law principles.
